Our terms of use

These terms tell you the rules for using our Vanquis app (the “app”).

Welcome to the Vanquis app (the “app”), provided by Vanquis Bank Limited (‘Vanquis’)  a company registered in England under company number 02558509 with its registered office at Fairburn House, 5 Godwin Street, Bradford, BD1 2AH (“we,” “us,” or “our”).

These Terms of Use (“Terms”) cover your access to and use of the app, including its content, functionality, and services. By downloading, accessing, or using the app, you agree to be bound by these Terms. If you don’t agree, please don’t use the app.

These Terms don’t have a fixed or minimum duration. They’ll apply until either you end this agreement, or we do.

Updates to these Terms

We may update these Terms to reflect changes in our services, legal requirements, or for other reasons. We’ll notify you of significant changes through the app, email, or our website. By continuing to use the app after the updated Terms take effect, you accept the changes. If you don’t agree, you must stop using the app.

Who can use the app

To use the app, you must:

  • Be at least 18 years old
  • Be a resident of the United Kingdom
  • Have the legal capacity to enter into a binding agreement

You can only register one account per person, unless we permit otherwise in writing. You must be the primary cardholder of the Vanquis Credit Card. You’re not allowed to use the app if you’re barred from using it under any applicable law or regulation.

For the Vanquis app to work at its best, your device needs to meet our operating system requirements. We support the latest iOS (Apple) and Android (Google) operating systems and the previous two versions.

The Vanquis app also may not work as designed if your device has been changed or tampered with (better known as ‘jail breaking’ or ‘rooting’), or if you use software which interferes with our ability to deliver the services.

We may release updates to the Vanquis app through the relevant app store. Depending on the update, you may not be able to use the app again until you’ve downloaded the latest version and accepted any new terms.

How to register for the app

To register you for the Vanquis app, we’ll send verification codes to the contact details we have for you. You’ll be asked to enter these codes. You’ll find instructions and help on how to register in our app and in our help centre. Please keep your contact details up to date.

Once you’ve registered, if you need to recover your account, we may also ask you to confirm your identity by taking a selfie or taking a photo of some identification. This is to keep your account secure. You can read how we process this information in our Privacy Notice.

What the app offers

The app provides a range of features and experiences so you can manage your account. This includes general servicing, payments, offers and more. We may introduce new features, which could have separate terms or fees. We’ll let you know about these in advance. We reserve the right to modify, suspend, or discontinue any part of the app’s services at any time, with or without notice. Unless required by law, we won’t be liable for any loss or damage resulting from these changes.

Managing your account securely

To access certain features, you’ll need to create an account by providing accurate, complete and up-to-date information. It’s your responsibility to keep this information up to date.

You’re responsible for all actions taken through your account. When using the app, you agree to act lawfully, not share your account with others, and avoid fraudulent, harmful, or illegal activities. You must not attempt to reverse engineer, decompile, or interfere with the app’s functionality.

If we believe you’ve breached these Terms or have security concerns, we may suspend or terminate your account without liability to you.

When you register, you choose a security passcode which you must keep secret. If you forget it, we’ll be able to help you reset it in some circumstances. We’ll never ask you to tell us your security passcode so you shouldn’t share it with anyone, even if you think they work for Vanquis.

The Vanquis app may also use your device’s biometric capabilities (such as fingerprint or facial recognition) to give you access, if you enable these.

As with any service holding your financial information, it’s important to keep any login details secure. We’ll make sure your Vanquis security credentials aren’t accessible to other parties and are transmitted through safe and efficient channels.

You must:

  • Take all reasonable steps to keep your security passcode and the device the Vanquis app is installed on, safe and secure
  • Never disclose your passcode or allow it to be used by anyone else
  • Never leave your device unattended while you’re logged in to the Vanquis app
  • Delete the Vanquis app first if you dispose of your device

If the device you’re using the Vanquis app on is lost or stolen, or you suspect someone else might know your security passcode, you must tell us immediately. We’ll help you change your security passcode (see ‘Contacting us’).

Vanquis is not responsible for any of your losses because of your security passcode being disclosed to anyone else or accessed by anyone else.

Fees and payments

We don’t charge a fee to use the app. But certain features of your Vanquis product may charge a fee. We’ll clearly communicate any fees before you incur them, and you agree to pay all applicable fees as outlined in our Vanquis Credit Card Terms and Conditions. Payments are processed by our third-party payment provider, subject to their terms. We’re not responsible for any errors or delays caused by them. Fees are non-refundable, unless required by law or specified in our refund policy.

The service provider for the phone the Vanquis app has been installed on may charge for internet access on the phone.

Vanquis Credit Card Terms and Conditions

Your Credit Card is issued by Vanquis Bank Limited. Vanquis Credit Card Terms and Conditions will still apply to the use of your Vanquis Credit Card. Any credit card bill payments you make through the Vanquis app will be governed by the Vanquis Credit Card Terms and Conditions.

If there is any conflict between these Terms of Use and the Vanquis Credit Card Terms and Conditions, the Vanquis Terms and Conditions will apply.

Your data and privacy

We comply with the UK General Data Protection Regulation (UK GDPR) and other data protection laws. We make sure your personal data is handled securely and only shared in line with our Privacy Notice.

Our intellectual property

The app and its content, including text, graphics, logos, and software, are owned by or licensed to Vanquis and protected by copyright, trademark, and other intellectual property laws. By agreeing to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from the app or its content without our prior written consent.

Vanquis®, Vanquis Bank® and Vanquis Credit Card® are trademarks licensed to Vanquis Bank Limited.

Our liability

To the fullest extent permitted by law, Vanquis, along with its affiliates, officers, directors, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the app. We don’t guarantee that the app will be uninterrupted, error-free, or secure – it’s provided “as is” and “as available,” without warranties, except as required by law. Nothing in these Terms excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.

Your responsibility to cover losses

You agree to indemnify and hold Vanquis harmless from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the app, or violation of any applicable law.

Ending your use of the app

You can stop using the app at any time by deleting your account and uninstalling it. We may terminate or suspend your access at our discretion, with or without notice, if:

  • You breach these Terms
  • We suspect fraudulent or unauthorised activity
  • We’re required to do so by law or for security reasons

On termination, your right to use the app ends, and we may delete your account data, subject to our Privacy Notice and legal obligations.

Applicable law and disputes

These Terms are governed by the laws of England. Any disputes arising from these Terms or your use of the app will be handled exclusively by the courts of England, though you may bring claims in the courts of your usual place of residence in the UK. Your use of the Vanquis app is also subject to the terms and conditions and privacy policies of the app store you downloaded it from.

Regulatory information

Vanquis Bank Limited is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority and the Prudential Regulation Authority (Financial Services Register No. 221156). Our services adhere to the Payment Services Regulations 2017, the Electronic Money Regulations 2011, and other relevant laws. If you have a complaint, please contact us in one of the ways listed below. If we can’t resolve it, you may be eligible to refer it to the Financial Ombudsman Service.

Other important information

These Terms, along with our Privacy Notice and any other terms we mention, form the entire agreement between you and Vanquis for the Vanquis app. If any part of these Terms is found invalid or unenforceable, the other parts will still apply. Our failure to enforce any right or provision doesn’t waive it. You can’t assign or transfer your rights or obligations under these Terms without our consent, but we may assign or transfer ours without restriction.

Network charges may apply. Calls to 01 and 03 numbers from UK landlines and mobiles are normally included in free plan minutes if available; otherwise calls to 03 numbers cost the same as calls to 01/02 prefix numbers. Calls to 0800 or 0808 numbers are free from mobiles and landlines.
